Employment law changes for casual employees

From 1 October 2018, casual employees can now request that their employment be converted from casual to full-time or part-time.

A casual employee who works a regular pattern of hours for at least 12 months may put in a request to their employer that they be converted to full-time or part-time employment. The employee’s request must be made in writing to the employer.

Once a request is made, an employer may either accept or reject the request. An employer may only reject the request on “reasonable grounds” and must provide reasons for the refusal to the employee within 21 days of the request.

Employers are required to notify their current casual employees of the right to request a conversion by 1 January 2019. Any new staff employed as a casual must also be notified of the provision within the first 12 months of employment.
